State Farm Insurance has new scam to rip off customers: This Week in the Law - June 26, 2012

State Farm Insurance Company sells Medical Payments Coverage to their automobile insurance customers in Florida, whenever they can. This coverage was designed to cover the 20% of the bills that Florida No-Fault/P.I.P. insurance does not cover. The reality is, if you have health insurance, they will cover the other 20% anyway and you do not need medical payments coverage. Most medical providers that work with lawyers in personal injury cases, routinely waive the "20% copay" anyway. What makes it worse is that after they pay the med-pay coverage, when you settle your personal injury case with the driver that caused your accident, State Farm then will put a lien on that settlement and make you pay them back every penny of medical payments they made. In effect, you pay the premium, receive the benefit and then have to give the benefit right back to them out of your settlement. This is a big rip off. Auto Insurance Rates: 82% swings in auto insurance premiums can occur based upon what zip code you live in. If you use a friend or family member's address, or lie about what city you actually live in, your insurance company can deny your coverage for fraud just when you need them most.... When a claim is being presented. All that money you are paying for coverage may be thrown out the window if there is no coverage when you have a claim. At that time, be prepared to show electric bills, water bills, regular mail, etc. coming to the address you claim you reside at if questioned by the insurance company. Seniors at the Wheel: May 3, 2012 Hello. This is Robert Gluck. Welcome to This Week in the Law. It is May 3, 2012. This week I wanted to talk to you about something that actually was reported in the Fort Lauderdale Sun Sentinel this week, and is rather important. We have a lot of elderly drivers here in South Florida and what has been happening is that many of them have been getting into major collisions causing, serious injuries and death, while making left turns. Left turns are very difficult for elderly people to make when their ability to observe and their ability to judge distance and their peripheral vision and their senses diminish as they get older. It is quite natural, as people get older, for their senses to diminish, but elderly people hold onto driving as that last grip on freedom, and what happens is that they keep driving longer than they should. UPS has a solution to make things much safer. They have a policy that says that if their drivers are making a left turn at an intersection they would prefer that they instead make three right turns. What they would do is they would pass the intersection, they would make a right turn, they would make another right turn and another right turn, and then they would avoid having to make a left turn. In Boynton Beach last week three elderly folks were in a vehicle. They make a left turn in front of an oncoming car, and of course those are the most significant impacts, because usually the oncoming vehicle is going at full speed. There were two people that were significantly injured and one fatality. Unfortunately, this happens daily in South Florida. For those of us that are driving in South Florida, if there is an elderly driver that is approaching an intersection, waiting to make a turn in front of you, do not assume they are going to stop. You have got to drive carefully and keep an eye on them, as they may start turning in front of you, and if they do, you have an obligation to take evasive action. Insurance Coverage Laws Changing : THIS WEEK IN THE LAW - 4/18/12: FROM FLORIDA PERSONAL INJURY TRIAL LAWYER ROBERT E. GLUCK: SUBJECT: Automobile insurance coverage laws changing January 31, 2013. Starting January 31, 2013, if you are injured in an accident in Florida, involving an automobile, whether you are a pedestrian struck by a motor vehicle, a bicyclist struck by a motor vehicle or a passenger or driver of a motor vehicle, (unless it is a taxi cab or unless it is a bus or other form of public transportation) it is going to be covered by Florida's no-fault law. No longer will your insurance cover massage therapy and no longer will your insurance cover acupuncture. Neither of those two modalities will ever be covered again in Florida. If a doctor declares that you suffered an emergency medical condition, then you are still entitled to the $10,000.00 of no-fault or PIP benefits to cover your medical bills, the same amount currently available. If a doctor determines that you do not have an emergency medical condition, you will be limited to $2500.00 for any medical treatment that you receive as a result of an accident. There is also a new requirement in the soon to take effect law, that if you do not present yourself for treatment to a clinic, medical doctor, physician's assistant or a dentist within 14 days after the accident, you injuries will not be covered. Please be aware of these changes in the law and do not get caught waiting too long to receive medical treatment if you feel you have been injured in an accident.
