Premises Liability Law

What do I do if I was injured at a friend’s house or a relative’s house?

Answer:
If the fall was due to a dangerous condition on their property, you should tell them the truth about your intentions. I would suggest you tell them that you would never consider going after their personal assets, but that you were injured, and if they have insurance on the property, you must make a claim. You might want to tell them that you intend to hire a lawyer to pursue a recovery for your pain and suffering, medical bills, lost wages, etc, only in the event that they have homeowner’s insurance. If they don’t, you probably won’t find a lawyer willing to take the case anyway, because the likelihood of recovering money damages for an uninsured owner or tenant is slim to none. Unless there is an unusual situation, most lawyers that handle these cases with some regularity will not consider taking a claim where there is no insurance unless it is against a large known commercial establishment that is “self insured”.
